Ark Tiles – Terms & Conditions

These Terms & Conditions apply to all purchases made from Ark Tiles Ltd (“Ark Tiles”, “we”, “us”, “our”). By placing an order with us, you agree to be bound by these terms in conjunction with our Shipping Policy, Returns & Refunds Policy, and Privacy Policy.

1. Interpretation

“Buyer” means anyone who places an order.
“Goods” refers to the tiles, adhesives, grouts, and related items supplied.
“Seller” refers to Ark Tiles Ltd, registered in England & Wales (company no. 16193202), trading from B2 Stag Industrial Estate, Coventry, CV6 5PY.
“Contract” is the agreement formed post‑order dispatch confirmation.

2. Contract Formation

Orders are offers. A Contract is only formed when Ark Tiles sends a “Dispatch Email” confirming shipment .

3. Basis of Sale

Sales are governed solely by these Terms.
Any other terms proposed by the Buyer do not apply unless explicitly agreed in writing.

4. Orders & Specifications

Buyers must verify all order details before placing orders.
Ark Tiles may make minor changes to comply with statutory requirements or supplier specifications.

5. Product Images, Samples & Colour Representation

All images displayed on our website, social media, marketing materials, and catalogues are provided for illustrative purposes only and may not represent real-life room settings, lighting conditions, or scale.
Colour shades, textures, finishes, and pattern variation may appear different in person due to lighting, screen calibration, photography, batch variation, and natural manufacturing tolerances.
Customers are strongly encouraged to view physical samples prior to placing an order where colour accuracy is critical.
While every effort is made to supply products from the same production batch, this cannot always be guaranteed unless expressly agreed in writing prior to order confirmation.
Where batch continuity is agreed, all products will be supplied from the same batch where reasonably possible. Minor shade or pattern variation remains an inherent characteristic of manufactured and natural products.

6. Orders, Acceptance & Contract Formation

An order is deemed accepted once Ark Tiles has issued an order confirmation or taken payment.
Ark Tiles reserves the right to refuse or cancel any order due to pricing errors, stock availability, supplier constraints, or operational limitations.

7. Order Amendments & Cancellations

Requests to amend or cancel an order must be submitted as soon as possible and no later than 5 hours after order confirmation, subject to the order not having entered processing, production, dispatch, or import scheduling.
Once processing has commenced or the order has been placed with a supplier or manufacturer, amendments or cancellations may no longer be possible.
Where cancellation is approved after processing has commenced, Ark Tiles reserves the right to deduct any costs already incurred.

8. Measurements, Quantities & Suitability

All product quantities supplied are based on the measurements provided by the customer.
Ark Tiles does not verify site measurements unless explicitly agreed in writing.
Customers remain fully responsible for ensuring suitability, compatibility, quantities, layout design, and installation requirements prior to placing an order.
Installation outcomes, cutting allowances, subfloor conditions, and workmanship are outside Ark Tiles’ control.

9. Pricing & Payments

All prices are subject to availability and may change without notice. Ark Tiles reserves the right to correct pricing errors or adjust prices prior to dispatch.
Any additional charges arising from special delivery requirements, re-delivery attempts, storage, import services, or handling will be communicated where possible and may be passed on to the customer.
Prices are as shown at checkout, including VAT and delivery (unless stated otherwise).
Payment is by card at the time of ordering.

10. Delivery & Risk Transfer

Delivery arrangements, estimates, attendance requirements, pallet handling, and courier limitations are governed by the Shipping Policy.
Risk in the goods passes to the customer once delivery has been completed and signed for or photographic proof of delivery has been obtained.
Buyers are responsible for unloading and accessing delivery locations.

11. Force Majeure

Ark Tiles shall not be liable for failure or delay in performing obligations where such failure or delay results from events beyond our reasonable control, including but not limited to supplier disruption, port congestion, customs delays, transport disruption, adverse weather, strikes, acts of government, or force majeure events.

12. Returns, Cancellations & Refunds

Returns, cancellations and refunds are governed by these Terms together with our Returns & Refunds Policy.

For standard stock items, change-of-mind returns are accepted only where the goods are returned to Ark Tiles within 14 calendar days of delivery.

Returned goods must be unused, unfixed, uncut, unaltered, in their original packaging, and in a fully resaleable condition. The customer is responsible for return carriage, safe packaging, and the risk of damage or loss during return transit, unless the goods are faulty, incorrect, or not as described.

Products clearly quoted, listed, or communicated as Special Order, Custom Order, Bespoke, Made to Order, Imported to Order, Manufacturer Direct, or similar are ordered specifically for the customer and are non-returnable, non-cancellable and non-refundable once the order has been confirmed, unless faulty, incorrect, or not as described.

This may include, but is not limited to, Quick-Step orders, manufacturer-direct orders, imported products, special-order flooring, trims, profiles, accessories, or any product where the customer has been informed before purchase that the item is a Special Order or Custom Order.

Nothing in these Terms or our Returns & Refunds Policy affects your statutory rights.
Return shipping costs and risks are the Buyer’s responsibility.
Refunds are issued within 5 business days of receiving returned Goods.

13. Faults & Warranty

Faults must be reported within 24 hours of delivery. Customer takes responsibility of viewing products in person as displayed in our showroom or order samples were possible to avoid disappointmnets in colour shades / sizes / texture etc. Ark Tiles is not responsible for orders with return requests with these reasons.
Ark Tiles will replace faulty Goods or offer refunds at its discretion.
No claims once tiles are fixed or altered.
Liability is capped at the price of the defective Goods.

14. Limitation of Liability

Ark Tiles is not liable for indirect or consequential losses.
Liability for personal injury or death remains unaffected.
Liability is limited to the purchase price of the Goods.

Nothing in these terms limits statutory consumer rights.

15. Intellectual Property

All intellectual property rights remain with Ark Tiles or its licensors.
Buyers are prohibited from using Ark Tiles’ branding or content without permission.
